The services and products offered on the Site are available to members of the Teachers Federation and other members of the education profession working and living in Australia and are not offered to any other person.

Where Teachers Health Insurance Services is offering a particular insurance product or service on the Site, Nadic, Teachers Health nor Teachers Insurance Services do recommend and endorse those products or services and they do take responsibility for content on the Site relating to those products and services.

The information provided on this Site is factual information and general advice – it not intended to be personal advice about whether the products or services promoted and marketed on the Site are suitable for your particular needs, objectives and circumstances.

Nadic may at any time and in its absolute discretion remove any content on any bulletin/message board on the Site. For the protection of all users of the Site, Nadic reserves the right to report any offensive, obscene, indecent, violent, defamatory, threatening, or other unsuitable behavior to the police.

Indemnification

You agree to indemnify, defend, and hold harmless Nadic, Teachers Health, Teachers Insurance Services, and any of their officers, directors, shareholders, employees, consultants, agents, and related bodies corporate from any and all third-party claims, liability, damages, and costs (including, but not limited to, reasonable lawyers' fees) arising from your use of the Site or your failure to comply with these terms and conditions, or from your violation of any applicable laws.

Intellectual Property Rights

The information, text materials, graphics, logos, button icons, images, video and audio clips, trade marks (whether registered or not), advertisements, layout, arrangement, graphical user interface, look and feel, and control features of the Site (“IP Content”) is protected by copyright, trade mark and other intellectual property laws.

You must not modify, copy, reproduce, republish, frame, upload to a third party, transmit or distribute in any way the IP Content except as expressly provided in these Terms and Conditions or as permitted by the Copyright Act.

The Teachers Health Insurance Services logo and name are the trade marks of Nadic and Teachers Health, and they along with the IP Content may not be used without permission and/or attribution.

Access

Nadic reserves the right to deny you access to, or use of, all or part of the Site, without prior notice, if you engage in any conduct that Nadic believes, in its absolute discretion: 

·         Violates any term or provision of the Terms and Conditions; or 

·         Violates the rights of Nadic or third parties; or 

·         Is inappropriate, unsuitable, obscene, indecent, offensive, violent, threatening, defamatory or otherwise damaging to Nadic or any other person

System Integrity & User Conduct

You must not use the Site to: 

·         Impersonate or otherwise misrepresent your identity or affiliation with any other person or entity; 

·         Send junk, inappropriate, obscene, indecent, offensive, violent, threatening or defamatory electronic mail or "spam" to people who would not wish to receive mail from you; 

·         Falsify or delete any attributions, legends, or other proprietary designations of origin or source of any content of the Site; 

·         Interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site; 

·         Attempt to gain unauthorised access to the Site or computer systems or networks connected to the Site through any means; 

·         Commit forgery or fraud (or attempted forgery or fraud), harm minors in any way or otherwise harass any individual; 

·         Collect or store personal data about other users, including e-mail addresses; or 

·         Violate any applicable state, Commonwealth law or regulation.

General

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible and will be deemed deleted to the extent that it is nor enforceable, and the remaining provisions of the Terms and Conditions shall remain in full force and effect.

The failure by Nadic or any other authorised person to insist upon or enforce strict performance of any of these Terms and Conditions will not be construed as a waiver of any right or remedy of Nadic or Teachers Health in respect of any existing or subsequent breach of these Terms and Conditions.
The law of New South Wales governs these Terms and Conditions.
